These Terms and Conditions apply to services supplied by Daring Energy Surveys Ltd. By accepting a quotation, confirming a booking or instructing us to proceed with a service, you agree to these Terms and Conditions.

Daring Energy Surveys Ltd provides property assessment and compliance services.
Domestic Energy Assessments are undertaken by an accredited Domestic Energy Assessor.

2. Our Services
Our services may include:
- Domestic Energy Performance Certificates (EPCs)
- Floor plans
- Legionella risk assessments
- Other property-related assessment services agreed with the customer
The service to be provided and applicable price will be confirmed when your booking is made.
3. Quotations and Bookings
Quotations are based upon the information supplied by the customer.
If the property or work required is materially different from the information provided when the quotation was issued, we will discuss any additional work or charges with you before proceeding where reasonably practicable.
A quotation does not guarantee an appointment until the booking has been confirmed.
4. Customer Responsibilities
The customer is responsible for:
- Providing accurate information about the property
- Ensuring that permission has been obtained for us to enter and assess the property
- Providing access at the agreed appointment time
- Informing tenants, occupants or other relevant persons about the appointment
- Providing safe and reasonable access to areas required for the assessment
- Informing us about known hazards or access restrictions
- Providing relevant documentation or evidence where requested
5. Property Access
Our assessor must be able to safely access the areas reasonably required to complete the booked service.
We will not enter areas where access would, in our reasonable judgement, be unsafe, inappropriate or likely to cause damage.
Unless specifically agreed otherwise, we will not:
- Move heavy furniture
- Remove fixed coverings, panels or building materials
- Carry out destructive investigations
- Enter unsafe lofts or confined spaces
- Undertake work which presents an unreasonable health and safety risk
Where an area cannot be accessed, the assessment will be completed in accordance with the applicable methodology and professional requirements where possible.
If an assessment cannot reasonably be completed because appropriate access has not been provided, an additional visit and fee may be required.
6. Energy Performance Certificates
Domestic EPC assessments are undertaken using the government-approved methodology applicable at the date of assessment.
The energy rating is determined by the property's characteristics and the evidence available to the assessor.
Where acceptable documentary or photographic evidence is unavailable, the assessor may be required to use applicable conventions, assumptions or default values.
Daring Energy Surveys Ltd cannot guarantee a particular EPC rating.
The EPC represents the property and evidence available at the time of assessment.
7. Floor Plans
Unless expressly agreed otherwise, floor plans supplied by Daring Energy Surveys Ltd are intended for general property information and marketing purposes.
They are not architectural drawings, measured building surveys or plans intended for construction, boundary determination, valuation or legal purposes.
Measurements, dimensions and floor areas are approximate and should not be relied upon where precise measurements are required.
8. Legionella Risk Assessments
Unless otherwise agreed, Legionella risk assessments are visual and non-invasive assessments of reasonably accessible parts of the property's water system.
A Legionella risk assessment does not guarantee that Legionella bacteria are absent from a property and does not include microbiological water testing unless expressly agreed.
Recommendations will be based upon the conditions identified at the time of assessment.
Responsibility for implementing recommendations and maintaining appropriate controls remains with the person responsible for the property.
9. Appointments
We will make reasonable efforts to attend at the agreed appointment time.
Occasionally an appointment may need to be changed due to illness, severe weather, travel disruption, unsafe conditions or circumstances outside our reasonable control.
Where this occurs, we will contact you and arrange another suitable appointment.
10. Cancellations and Rescheduling
Please provide as much notice as possible if you need to cancel or rearrange an appointment.
Our standard cancellation policy is:
- More than 24 hours before the appointment – no cancellation charge.
- Less than 24 hours before the appointment – we reserve the right to charge a reasonable cancellation fee reflecting costs incurred.
- Where the assessor attends but cannot gain access to the property – we reserve the right to charge a reasonable failed-appointment fee.
Any cancellation charge will be reasonable and proportionate to the circumstances.
Your Statutory Cancellation Rights
If you are a consumer and book our services online, by telephone or away from our business premises, you may have a statutory 14-day cancellation period.
If you request an appointment or ask us to begin providing the service within this period, you expressly request that performance of the service begins before the cancellation period has expired.
If you subsequently cancel after work has begun, you may be required to pay a proportionate amount for services already provided.
Where the service has been fully performed following your express request and acknowledgement, your statutory right to cancel may end once the service has been completed.
Nothing in these Terms and Conditions affects your statutory rights.
11. Prices and Payment
The price of your service will be confirmed before your booking.
Payment is due in accordance with the terms stated on your quotation, booking confirmation or invoice.
Reports or certificates may be withheld until payment has been received where legally permitted.
Additional services requested by the customer may be subject to additional charges, which will be agreed before the additional work is undertaken.
12. Reports and Certificates
We aim to provide reports and certificates within a reasonable period following completion of the assessment.
Timescales may occasionally be affected by additional evidence requirements, accreditation requirements, software availability or circumstances outside our reasonable control.
Reports and assessments relate to the property and conditions identified at the time of inspection.
13. Photographs and Assessment Evidence
Photographs may be taken during an assessment where reasonably necessary to:
- Record property characteristics
- Support assessment findings
- Meet accreditation or audit requirements
- Provide evidence supporting a report or certificate
Photographs and assessment evidence will be handled in accordance with our Privacy Policy.
14. Accuracy and Limitations
Our assessments are based upon visible and reasonably accessible property characteristics, information supplied by the customer or occupier, available documentary evidence and applicable professional methodologies.
We cannot be responsible for property characteristics, defects or information which could not reasonably have been identified during the agreed assessment.
15. Standard of Service
Daring Energy Surveys Ltd will provide its services with reasonable care and skill.
Nothing within these Terms and Conditions excludes or restricts statutory consumer rights which cannot legally be excluded.
16. Liability
We are responsible for losses which are a reasonably foreseeable consequence of our failure to exercise reasonable care and skill or our breach of contract.
We will not be responsible for losses arising from:
- Incorrect or incomplete information supplied to us
- Areas which could not reasonably or safely be accessed
- Changes made to the property after the assessment
- Use of a report or floor plan for a purpose for which it was not intended
Nothing within these Terms excludes or limits liability where doing so would be unlawful.
17. Complaints
If you are unhappy with our service, please contact us so that we have an opportunity to investigate the matter.

18. Privacy
Personal information is collected and processed in accordance with our Privacy Policy and applicable UK data protection legislation.
19. Changes to These Terms
We may amend these Terms and Conditions from time to time.
The Terms applicable to your service will normally be those in effect when your booking is confirmed.
20. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Nothing within this provision affects any mandatory legal rights available to consumers.
